These Terms and Conditions govern access to ConsTrack, a construction business management service operated by the individual identified above, using the unregistered brand Suturalysis IT Solutions. “We”, “us” and “our” refer to that individual operator. Suturalysis IT Solutions is not currently a registered business or a separate legal entity. “You” means the individual using ConsTrack or the business that individual is authorized to represent. These terms apply to ConsTrack; they do not automatically govern other products we may offer.

1 Agreement and eligibility

Before creating a workspace or accepting an invitation, read these terms and the ConsTrack Privacy Policy. Where you act for a business, you confirm that you have authority to accept these terms for that business. You must have the legal capacity to enter into this agreement. Accounts must be controlled by an adult authorized to act for the business.

Your agreement to these terms is separate from any optional consent to receive marketing. Reading or acknowledging the Privacy Policy does not waive your privacy rights or authorize unrelated uses of personal information.

2 Accounts and workspace administration

Provide accurate account information, use an email address you control, and complete required verification. Protect your sign-in credentials and promptly report suspected unauthorized access. Do not share personal sign-in credentials or use another person’s account without permission.

A business workspace administrator controls invitations, project assignments and available permissions. Administrators must grant access only to authorized people, review access when responsibilities change, and remove access when it is no longer needed. Selecting an owner or job-title label does not establish legal ownership of a business or grant website-owner privileges.

Access depends on your verified identity, active membership and permissions. Leaving a business, losing an assignment or having an account suspended may end access to its records. Your departure does not automatically delete records the business is entitled or required to retain.

3 The service and its limits

ConsTrack provides tools for construction records, project planning, progress reports, procurement, inventory, expenses, payroll records and billing records. Availability depends on the features enabled for your workspace and plan. Demonstration workspaces contain sample data and must not be mistaken for your live business records.

ConsTrack does not itself transfer employee salaries, collect your construction customers’ debts, certify work, approve regulatory filings or guarantee that calculations satisfy local accounting, employment, engineering or tax rules. Review outputs before relying on them. Maintain records and independent exports appropriate to your business obligations.

4 Plans charges and billing

The plan, currency, price, included allowances, billing period, applicable taxes and any add-ons must be disclosed before you purchase. Your current subscription record or accepted order identifies your purchased entitlement. We will not charge an additional fee solely because you reach a usage limit; an upgrade or add-on requires authorization.

We may introduce, withdraw or change publicly offered prices and plans for future purchases. Those changes do not by themselves change an existing subscription or an accepted order. The current advertised paid plan is PHP 2,999 per month with the owner plus five additional people per project and unlimited projects, subject to the allowances disclosed with the purchase. Your accepted order or subscription record governs any separately agreed entitlement.

For an existing paid subscription, we will give at least 30 calendar days’ advance notice of a price increase or a material reduction in included features or allowances, or any longer notice required by applicable law or your accepted order. The change will apply no earlier than the first renewal occurring after that notice period. Notice will identify the change, effective date and cancellation method and will be sent to your account email or delivered through a prominent account notice. You may cancel renewal before the change takes effect and retain access for the period already paid for. We will obtain fresh agreement or payment authorization where required; this clause does not itself authorize a higher debit.

We may make routine improvements and give reasonable notice of changes to free plans. A change required urgently to address security, abuse or legal obligations may take effect sooner, with notice as soon as reasonably practicable where lawful. That exception does not authorize an unannounced price increase or remove mandatory cancellation, refund or other legal rights.

If recurring billing is offered, you must expressly authorize it after the amount or calculation method, renewal frequency and cancellation method are disclosed. Using a free workspace or accepting these terms does not by itself authorize recurring debits. Any payment authorization is separate from these terms.

PayMongo is the intended provider for future online checkout. An available checkout must identify the actual payment provider and payment conditions before you authorize a transaction. These terms do not represent that online checkout or automatic renewals are already enabled. A payment provider may apply its own terms and privacy notice to its payment service.

Invoice, receipt and refund entries in the owner dashboard are administrative records. Creating an entry does not itself charge a customer, move money, issue a bank refund or change subscription access. Monthly usage snapshots are recorded administrative totals and do not by themselves authorize extra charges.

5 Cancellation and refunds

You may cancel renewal at any time. Cancellation stops future renewals, and access continues until the end of the period already paid for, unless access must be restricted for a lawful security, abuse or legal reason. Use the cancellation method provided with your subscription or contact support. We will confirm cancellation and its effective date.

Except for billing errors and refunds required by applicable law, subscription fees already paid are not refundable and are not prorated for unused time. This does not limit a statutory cooling-off, withdrawal, cancellation or other mandatory consumer right. Any more favorable refund offer expressly provided with your purchase will also apply.

Report a duplicate, unauthorized or incorrect charge promptly through support and provide enough information to locate it. We may verify the request and coordinate with the payment provider. Approved refunds are returned through the original payment method where possible; provider or bank processing times may vary. We do not promise a refund-processing period that the payment provider or bank cannot meet.

Canceling renewal and requesting account or workspace deletion are separate actions. Deleting local browser data does not cancel a paid subscription or send a deletion request to us.

6 Your records and permissions to process them

You retain the rights you hold in the records and files you submit. You grant us permission to host, copy, transmit, back up and otherwise process those records only as needed to provide and protect ConsTrack, follow your lawful instructions and meet applicable legal obligations. This permission does not transfer ownership of your business records to us.

You are responsible for the authority and lawful basis to upload information about workers, customers, suppliers and other people. Provide required notices and obtain any consent or other authorization the law requires. Upload only information reasonably needed for your business purposes, and do not put passwords or payment-card security codes in reports or support messages.

You control exports and any sharing outside ConsTrack. Once you download or send a file to another person, that copy is subject to your handling and the recipient’s handling. Correct errors in source records rather than assuming an export updates itself.

7 Acceptable use

Do not use ConsTrack to break the law, infringe others’ rights, upload malicious files, impersonate someone, misrepresent approvals or payments, access another person’s private records, bypass permissions or plan limits, or disrupt the service. Do not probe or attack infrastructure without our prior written authorization. Report suspected vulnerabilities privately through the published security or support contact.

Use only information and files you are entitled to submit. Do not use multiple accounts or fabricated business identities to evade restrictions. We may apply reasonable file, request and rate limits to protect availability and prevent abuse.

8 Support requests

A support request, its replies and its screenshots are available within the application only to the person who submitted the request and authorized website-owner support access. Coworkers and company administrators do not receive access merely because they belong to the same business. Technical service providers may process these records to operate the service, as described in the Privacy Policy.

Support is provided through the channels made available in the application and our published contact details. Priority labels help organize requests; they are not a guaranteed response or resolution time. No service-level commitment applies unless we separately agree to one in writing. Support is not an emergency-reporting service.

9 Automated assistance and third party services

If an AI or automated assistance feature is made available, review its output independently. Predictions, summaries and generated text can be inaccurate or incomplete and are not professional engineering, legal, accounting, tax or safety advice. Do not submit sensitive information that the feature does not need. We will identify relevant data use before enabling a feature that materially changes how records are processed.

Third-party authentication, hosting and payment services may have separate terms. We remain responsible for our own obligations under applicable law; a reference to a third party does not eliminate those obligations. We do not endorse a third-party website merely because we link to it.

10 Availability changes and suspension

We use reasonable efforts to operate and protect the service, but maintenance, provider outages and other events can interrupt it. We do not promise uninterrupted access, error-free outputs or a particular feature roadmap unless separately agreed in writing. Notify us of a material defect so we can investigate.

We may restrict access where reasonably necessary to address nonpayment, a material breach, a security threat, suspected unlawful use or a legal requirement. Where lawful and practicable, we will explain the reason and provide a reasonable opportunity to address it. Urgent restrictions may take effect immediately. Any cancellation or refund right required by law remains available.

11 Ending access and handling records

You may stop using ConsTrack and ask to close your account or workspace. A person requesting deletion must have authority over the relevant account or records. We may verify identity and coordinate with a business administrator where the request concerns shared business records. Privacy requests about your own information remain available independently of an administrator’s commercial preferences.

Before ending a workspace, export records you are entitled to retain. We will explain available export and deletion options when handling closure. Some information may need to remain for legal, accounting, dispute, security or recovery purposes, as explained in the Privacy Policy. We do not promise immediate deletion from every backup or from copies already exported by other authorized people.

12 Intellectual property and feedback

We or our licensors retain rights in the ConsTrack software, design, documentation and branding, excluding rights you hold in your own content. We grant you a limited right to use the service for its intended purpose while you comply with these terms and your subscription conditions. You may not resell access, copy protected software or claim our branding as your own without permission, except where applicable law allows it.

You may provide suggestions voluntarily. We may consider and use feedback to improve the service, but this does not give us ownership of your confidential business records or permission to publish them.

13 Responsibility and mandatory rights

Each party remains responsible for its conduct and obligations under applicable law. You are responsible for your business decisions, the accuracy of information you enter, and the permissions you grant. We remain responsible for the obligations the law places on us as the service operator.

To the extent permitted by law, we do not give a guarantee that ConsTrack is suitable for every business purpose or that forecasts will match actual results. Nothing in these terms excludes or limits liability for fraud, willful misconduct, or any liability or consumer right that cannot lawfully be excluded or limited.

14 Governing law disputes and changes

These terms are governed by the laws of the Philippines, subject to any mandatory protections and forum rights that apply to you under the law of your place of residence. Nothing requires a consumer to give up a right to bring a claim in a court or before a regulator that applicable law makes available.

Please contact us first about a dispute so we can try to resolve it, without limiting urgent remedies, complaint rights or applicable filing deadlines. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.

These terms apply to new acceptances from 21 October 2026 and to existing users from 20 November 2026, subject to any further notice or agreement required by applicable law. Until then, the previous terms continue to govern existing users. No existing agreed price is changed by publishing these terms. For material changes, we will provide notice and obtain agreement again where required by law. A revised document will not falsely be recorded as a version you accepted earlier. If you do not agree to a proposed change, contact us about cancellation, export and closure options before it applies.
